Agreement and operator

These Terms of Use ("Terms") are an agreement between you and Individual Entrepreneur YEVGEN KAPELKO, located in Ukraine at 79/5 Pushkinska Street, Kharkiv 61000, Ukraine ("Flourtune", "we", "us", or "our"). They govern your use of the Flourtune mobile application, website, and related services (the "Service"). By creating an account, starting a subscription, or using the Service, you agree to these Terms and the Privacy Policy.

Eligibility and accounts

You must be at least 18 years old and legally able to enter this agreement. You are responsible for the accuracy of your account information, keeping access credentials secure, and all activity under your account. Notify us promptly if you suspect unauthorized access. You may not share an account in a way that bypasses subscription terms or technical limits.

The Service

Flourtune helps bakers organize recipes, ingredients, purchases, inventory, clients, orders, tasks, costing, pricing estimates, exports, and related business information. Features may change as the product develops. We may make reasonable changes for security, legal compliance, platform requirements, or product improvement.

Flourtune is a calculation and organization tool. It is not accounting, tax, legal, food-safety, medical, or financial advice. Results depend on the data and assumptions you provide. You are responsible for verifying costs, prices, allergens, taxes, measurements, customer details, and business decisions.

Your content and responsibilities

You retain ownership of content you submit to the Service. You grant us a limited, worldwide license to host, process, transmit, reproduce, and format that content only as needed to operate, secure, and improve the Service and provide features you request.

You must have the rights and lawful basis necessary to use all submitted content, including customer personal data, recipes, images, trademarks, and third-party materials. You must not upload unlawful, infringing, malicious, deceptive, or dangerous content; violate another person's privacy; interfere with the Service; reverse engineer protected parts except where law permits; or evade access, quota, or security controls.

AI-assisted features

Recipe and receipt scans use automated systems and can produce incomplete or incorrect results. You must review extracted quantities, ingredients, prices, dates, taxes, allergens, and other details before relying on or saving them. AI output is not authoritative professional advice. Usage limits may apply to protect reliability and operating cost; current limits are shown in the Service or subscription materials.

Subscriptions and billing

Paid access is offered as an automatically renewing monthly Flourtune Plus subscription through Google Play or Apple. The localized price, taxes, billing period, and date of the next charge are displayed by the store before confirmation. Store terms also apply. Flourtune does not currently offer a free trial.

Subscriptions automatically renew unless you cancel through the relevant store before the renewal deadline shown by that store. The store charges your payment method and handles payment details, refunds, and billing disputes under its rules. Deleting the app or your Flourtune account does not cancel a store subscription.

When paid access expires, Flourtune may place the account in read-only mode. Existing data remains viewable and exportable, but creating, editing, deleting, or using paid processing features may require an active subscription. Temporary billing grace or account hold behavior follows the store and entitlement state.

Cancellation and refunds

Manage or cancel subscriptions in Google Play or Apple account settings. Refunds are handled by the store except where applicable law requires us to act directly. Cancellation normally stops future renewal and does not remove access before the current paid period ends, subject to store rules.

Intellectual property

The Service, excluding your content, is owned by us or our licensors and is protected by intellectual-property laws. These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. No other rights are granted.

Availability and termination

We aim to provide a reliable Service but do not guarantee uninterrupted or error-free availability. Cloud, store, network, device, and third-party outages may affect access. We may suspend or terminate access where reasonably necessary for security, abuse prevention, non-payment, legal compliance, or a material breach of these Terms. Where practical, we will provide notice and an opportunity to export data.

You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination—including ownership, disclaimers, liability, and dispute terms—continue to apply.

Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available". We disclaim warranties that are not expressly required by law, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. Nothing in these Terms excludes mandatory consumer rights.

Limitation of liability

To the maximum extent permitted by law, Flourtune and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, goodwill, or data arising from the Service. Our aggregate liability arising from the Service will not exceed the amount you paid for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot legally be limited.

Governing law and disputes

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles. Courts of Ukraine having competent jurisdiction will resolve disputes, except where mandatory consumer law allows you to bring a claim elsewhere. Before filing a claim, please contact us so we can try to resolve it informally.

The Service may be offered worldwide, subject to Google Play or App Store availability and applicable local laws. Mandatory rights available to you under the laws of your place of residence are not excluded by these Terms.

Changes

We may update these Terms for legal, security, or product reasons. We will post the updated Terms, change the date above, and provide additional notice when required. If you do not accept a material change, you should stop using the Service and cancel any future renewal.
